Responding to Unity's report of the recent meeting between the Ayuntamiento and the residents of Costambar, the Junta de Vecinos objected to our questioning of "information, loaded with errors and falsehoods, put forward by the Junta...". The following is Unity's explanation as to why we felt that the information put forth was inadequate and incorrect (supplied in English and Spanish):

1. FALSEHOOD Mr. Bustos and Mr. Dominguez put forward prepared statements in the name of the Junta de Vecinos. That organization had an election in 2010 and elected a Board for a period of two years. That term expired in March 2012 and no subsequent election has been called. The Board’s term has expired. Mr. Bustos and Mr. Dominguez therefore appeared in their own right as individuals and not as our representatives.

This is not to suggest we do not appreciate the efforts of both of these men have made, but they insisted the APC President comply with the law, so it is only fair they do the same. We are all members of the Junta de Vecinos by virtue of the fact we live here and want to be able to elect our representatives. At the most recent election in February 2012 there was a turnout of about 250 people who are both members of the junta and actively involved with the maintenance function.

2. FLASEHOOD Mr. Bustos spoke at the meeting about how Cofresi and other communities are not “private communities” nor was Costambar. A Presidential order in 1972 made Parcela 215, 250 acres, known as Costambar, into a ‘Planned Tourist Community’; therefore private, unlike the others he cited. This status has been confirmed by the Central Bank and El Sindico Ramon Ortiz. This happened at the same time that Casa de Campo was established on the South Coast. We just didn’t get the competent managers they did. This status can be changed only by another Presidential order.

3. ERROR The shortcomings evident in the project were cited and we agree with them, however what The Club de Golf and Messer’s Dominguez and Bustos failed to mention is that they have a firm policy of refusing to pay maintenance in support of the services and share a heavy responsibility for the failure of APC to deliver these services.

4. ERROR. The solution to our problem was identified as being a structural one, when we would submit, as Claudia Docker pointed out at the meeting, that most of the problems were caused by the lack of cooperation between three key players. Over the past two and a half years we, the people who vote for both APC and the Junta de Vecinos have seen personal hostility fester and bring both Mr. Bustos and Mr. Dominguez who lived among us without taking part the activities of the community at large become highly active politically. Both for good and bad.

Ing. Vallarino does not have to satisfy voters, and as a developer his interests are different from ours, but APC and the Junta de Vecinos have both failed to work out an accord so that each group delivers services required by the community. APC provides maintenance services while the Junta deals with crucial issues, such as Roads, Water and Electricity. These latter two organizations require an election every two years, so if they do not accomplish a productive working relationship, we the residents should replace them with people who will work together,

5. REBUTTAL: APC has delivered maintenance services since September 1998. That came about when Ing. Vallarino closed the maintenance office and left us with no other option. Since then APC has purchased equipment and employed staff to carry out the services. APC is limited only by its budget. Ron Moran, who was elected as Treasurer 2008 to 2010 did an analysis that suggested that 70% of the property owners paid their maintenance but that only covered 50% of the properties. That left us with the conclusion that there were multiple property owners who failed to support the community as well as the people we mentioned above.

The issue which was not resolved at the meeting was “The Elephant in the Room”. Where will the money come from to pay for the suggestions made at the meeting? Their suggestions do not touch on this point and there is no reason to believe it will bring new payers on board.

Having given this outline we want to stress we mean no disrespect to either Mr. Bustos or Mr. Dominguez. Let us compartmentalize our activities so the Junta does its work, Ing. Vallarino does his, and APC does its work. We can resolve our problems without involving others.

The Unity Group has pledged to work cooperatively with the community at large, the Juntas de Vecinos. Ing. Vallarino and the Ayuntamiento or any other government group for the betterment of Costambar.

Respuestas a cuestiones planteadas por Gus Dominguez & Gonzalo Bustos.



1- Falsedad.- Los Sres. Bustos & Dominguez expusieron declaraciones preparadas en nombre de la Junta de Vecinos. Esa organizacion sostuvo unas elecciones en el 2010, cuando eligio una Directiva for un periodo de dos anos. Ese periodo expiro en Marzo del 2012 y no han tenido ningunas elecciones subsecuentemente. El periodo de aquella Directiva ha expirado. De por tanto, los Sres. Bustos & Dominguez comparecieron a tal reunion como individuos y no como nuestros representantes.

No queremos sugerir que no apreciamos los esfuerzos que ambos han hecho, pero ellos insistieron que el presidente de APC actuase dentro del marco de la ley, por lo cual, no es mas que justo que ellos hagan lo mismo. Todos nosotros somos miembros de la Junta de Vecinos por virtud del hecho que vivimos aqui y queremos poder elegir a nuestros representantes. En las mas recientes elecciones de Febrero del 2012, unas 250 personas asistieron, entre ellas miembros de la Junta de Vecinos activamente involucrados en las funciones del mantenimiento.

2- Falsedad. El Sr. Bustos hablo en la reunion acerca de como Cofresi y otras comunidades “no son comunidades privadas”, como tampoco lo era Costambar. Un Decreto Presidencial en el 1972 convirtio la parcela 215 (unos 250 acres), conocida como Costambar, en una “comunidad turistica planeada”, de por tanto privada, en contraste a las otras comunidades citadas. Este estado juridico fue confirmado por el Banco Central y el antiguo Sindico Ramon Ortiz. Esto acontecio al mismo tiempo que se establecio Casa de Campo en la costa sur. Solo que nosotros no obtuvimos los gerentes competentes que ellos consiguieron. Este estado juridico solo se puede cambiar a traves de otro Decreto Presidencial.

3- Error. Los defectos evidentes en el proyecto fueron enumerados y estamos de acuerdo en ese sentido, no mas que al Club de Golf y los Sres. Dominguez & Bustos se les olvido mencionar que tienen una firme politica de rehusar a pagar mantenimiento en respaldo de los servicios y asi comparten una gran responsabilidad en el fracaso de APC como suministradora de tales servicios.

4- Error. La solucion de nuestros problemas se identifico ser de tipo estructural, cuando uno se compenetra – como Claudia Docker menciono en la reunion – de que la mayoria de los problemas eran causados por la falta de cooperacion entre las tres figuras principales. Durante los ultimos 2 anos y medio, nosotros – las gentes que votamos por APC y la Junta de Vecinos – hemos sido testigos de la hostilidad personal enconada que ha conllevado a los Sres. Bustos & Dominguez, quienes han convivido entre nos sin tomar parte en las actividades de la comunidad entera, a tornarse politicamente activos. Para bien y mal.

El Ingeniero Vallarino no tiene que satisfacer a votantes y como desarrollador, sus intereses difieren de los nuestros, pero APC y la Junta de Vecinos ambas han fracasado en lograr un acuerdo para que cada faccion suministrase los servicios requeridos en la comunidad. APC suministraria servicios de mantenimiento, mientras que la Junta de Vecinos se encargaria de asuntos importantes como las calles, agua y electricidad. Estas dos ultimas organizaciones requieren elecciones cada dos anos, de manera tal que si no logran el acometido de unas relaciones productivas, nosotros los residents debemos reemplazarlos con gentes que puedan laborar en conjunto.

5- Refutacion. APC ha suministrado servicios de mantenimiento desde Septiembre del 1998. Esto acontecio debido a que cuando el Ingeniero Vallarino cerro la oficina de mantenimiento, nos dejo sin ninguna otra alternativa. Desde entonces, APC ha adquirido equipos y el personal para acarrear tales servicios. APC esta limitada solamente que por su presupuesto. Ron Moran – quien fue elegido Tesorero para el periodo 2008-2010 – llevo a cabo un analisis que revelo que el 70% de los propietarios pagaban sus cuotas de mantenimiento, pero aquello solo representaba a un 50% de las propiedades. Este encuentro conllevo a la conclusion de que existian gentes que tenian multiples propiedades, quienes no estaban respaldando a la comunidad, tal como lo hacian los otros propietarios arriba indicados.

El asunto que no se resolvio en la reunion fue “el elefante en la sala”. De donde va a salir el dinero para costear las sugerencias enumeradas en la reunion? Sus sugerencias no tocaron sobre este tema y no existe razon para creer que induciran a que la gente pague.

Habiendo expuesto estas aclaraciones, queremos hacer hincapie en que no es nuestra intencion mostrar falta de respeto ni al Sr. Bustos o el Sr. Dominguez. Tenemos que compartamentalizar nuestras actividades a fin de que la Junta de Vecinos haga su trabajo, el Ingeniero Vallarino el suyo y APC lleve a cabo sus labors. Podemos resolver nuestros problemas sin involucrar a otros.

El Grupo de Unidad ha prometido laborar cooperativamente con todo el ambito de la comunidad, la Junta de Vecinos, el Ingeniero Vallarino, el Ayuntamiento y cualquier otro grupo gubernamental, para el mejoramiento de Costambar.
