NOTICE TO RESIDENTS, PROPERTY & BUSINESS OWNERS OF COSTAMBAR

Costambar is a tourist zone created by a Presidential decree in 1972. The city of Puerto Plata (POP) does not provide normal municipal services such as street lights, garbage collection, street repairs, or upkeep of the beach because Costambar is a private project. In fact, POP charges the property owners of Costambar, through its association APC, RD$ 30,000 per month for the right to dispose the garbage at the municipal dump. These charges and the operational cost of other services amount to 5 million pesos in 2010; of which 69% goes to employees, 19% for utilities, rents, vehicles, supplies, etc., 7% as garbage fees to POP, and 5% for street lights and other expenses. By function, 46% is spent on collective security, 32% on cleanliness and upkeep, 8% on street lights and repairs, and 14% on administration of these services.
Unfortunately, a good number of owners many of whom are relatively well off foreigners have chosen not to pay for these services, making others shoulder the entire burden. Their failure to pay has resulted in disrepair of the streets of Costambar. Moreover, these non-payers are stealing from poor Dominican workers employed by APC because their failure to pay makes it impossible to pay adequate employee benefits.
The non-payers cannot be allowed to undermine the welfare of Costambar, especially in keeping it safe and clean. Not a single successful incident of theft has been reported in the past 4 months in Costambar. The new Board of Directors of APC is therefore taking measures to enforce the payment of dues and collect unpaid dues so that streets can be repaired and that residents of Costambar enjoy a safe and clean environment.
The 2010 monthly dues presented by the new Board, and approved by the General Assembly on February17, 2010, have for the first time a rational basis that is fair and applicable uniformly to all properties. The new formula will result in reduced rates for most property and business owners.
Condos/Apartments (Individual) RD $ 400 + 4X Living Area (m2)
Houses/ Buildings RD $ 700 + 4X Living Area (m2)
Vacant Lots (depending on size) RD $ 200 – 400
Businesses (Type of Business) RD $ 700 - 1600
Each payer will receive a bill each quarter beginning April 1, 2010. A penalty fee of 10% will be added to the amount outstanding at the end of the quarter.
Non-payers have a window of opportunity to meet with the new Board and resolve any issues they might have with APC and begin paying their dues. There is no excuse, except bankruptcy, for not paying the dues, and non-paying businesses should not expect the Community to support their businesses.
New identity passes for residents of Costambar, their vehicles and workers will be issued as of March 15, 2010. The Green Gate will be reserved exclusively for payers and their workers. Residents and visitors entering through the Main Gate will be required to identify themselves and subject to verification as needed for reasons of security. All property and business owners are advised to go to the APC office, pay their dues, obtain new identity passes for their vehicles, for themselves if entering on foot, and for their workers and tenants to avoid delays and inconveniences.
If a non-payer persists in not paying, APC will discontinue services such as garbage collection to all properties and businesses owned by the non-payer, will publish the non-payer’s name, and as a last resort take legal action to enforce payment. A non-payer shall be responsible for all legal costs incurred by APC, and will remain liable for all dues despite the discontinuance of certain services. Presently, a test case where a property owner owes substantial back dues is in the Puerto Plata Civil Court for adjudication.

AVISO A PROPIETARIOS Y NEGOCIANTES DE COSTAMBAR

Costambar es una zona turistica creada en 1972 por decreto presidencial. El ayuntamiento de Puerto Plata (POP) no provee servicios municipals tales como alumbrado en las calles, recogida de basura, reparo de calles, o mantenimiento de la playa, porque Costambar es un projecto privado. En verdad, Puerto Plata le cobra a APC (Asociacion de Propietarios de Costambar) RD$ 30,000 mensuales por el derecho a botar basura en el vertedero municipal. Estos cobros y el costo de operar otros servicios se remontaran a unos RD$ 5 millones en el 2010; de estos gastos el 69% seran salarios de empleados,19% en electricidad, agua, alquiler, vehiculos, abastecimientos, etc., 7% pagos para la basura a Puerto Plata, 5% en alumbrado de calles y otros gastos. Si se separan los gastos por funciones, 46% se gasta en la seguridad colectiva, 32% en limpieza y mantenimiento, 8% en reparo de calles mas 14% en la administracion de tales servicios.

Desafortunadamente, un buen numero de propietarios – muchos de ellos extranjeros acaudalados – han escogido no pagar por tales servicios, dejando que sean otros quienes tengan la carga de pagar por todo. Esta actitud ha resultado en la falta de reparo de las calles. Pero aun mas, tambien le estan robando a los pobres Dominicanos empleados de APC, porque al no pagar, es imposible proveer los beneficios adecuados a nuestros trabajadores..

No se puede permitir que los que no pagan comprometan el bienestar de Costambar, especialmente en mantener la seguridad y limpieza de que gozamos, ya que en los ultimos 4 meses, no se ha reportado ni un incidente de robo en Costambar. La nueva Directiva de APC esta tomando medidas para enforzar el pago y cobrar deudas pasadas, a fin de que se puedan reparar las calles y los residents de Costambar gozen de un ambiente de seguridad y limpieza.

Las cuotas de mantenimiento mensuales del 2010 presentadas por la nueva Directiva y aprobadas por la asamblea general el 17 de Febrero del 2010, tienen por primera vez unas bases razonables, justas y aplicables uniformemente a todas las propiedades. La nuevas formulas resultaran en una reduccion para la mayoria de los propietarios y duenos de negocios. Por ejemplo:

Condominios/apartamentos individuales RD$ 400 + RD$ 4 x m2 en area

Casas/Edificios RD$ 700 + RD$ 4 x m2 “

Solares vacios (dependiendo del tamano) RD$ 200-400

Negocios (tipo de negocios) RD$ 700-1600

Cada persona recibira una cuenta trimestralmente, comenzando el 1o. de Abril del 2010. Se le agregara una multa del 10% a lo aun debido al final de este trimestre. Se les ofrece a los deudores la oportunidad de reunirse con la nueva Directiva y resolver cualquier asunto que puedan tener con APC en comenzar a pagar sus cuotas. No habra excusa para no pagar, excepto estar en bancarota.

Se expediran nuevos carnets de identidad a los residents de Costambar, sus trabajaores y vehiculos, a partir del 15 de Marzo del 2010. El uso de la Puerta Verde se reservara exclusivamente para los que pagan y sus empleados. Residentes y visitants entrando por la Puerta Principal tendran que identificarse y seran sujetos a la verificacion necesaria por razones de seguridad. Se le aconseja a todos los propietarios y duenos de negocios, pasar por la oficina de APC, pagar sus cuotas, obtener nuevos carnets de identidad para sus vehiculos o si mismos si entrando a pie y empleados, para asi evitarse demoras o inconvenientes.

Se descontinuaran servicios como la recogida de basura de todas las propiedades perteneciendo a deudores que persistan en no pagar y como ultimo recurso, se iniciaran acciones legales para obligarlos a pagar. Todos costos legales de APC seran la responsabilidad de los deudores. Se continuara cobrando por servicios aunque se hayan descontinuado por falta de pago. El primer caso tal se encuentra actualmente en los tribunals civiles de Puerto Plata, ya que este deudor debe una cantidad substancial.
